Terms and conditions

The following terms and conditions are applicable between you (‘the client’ ‘you’) and Skywalkr IVS (‘Skywalkr’ ‘we’ ‘us’). This document exists to protect both you and us. By signing up and using Skywalkr’s hosting service, you and the company you represent, automatically give us consent to these terms and conditions including Skywalkr’s privacy policy.

The hosting agreement

You as a client is obligated to maintain and update your data, especially your e-mail, which is our primary way of contacting you.
The hosting agreement runs for 1 year at a time, starting on the day that the subscription is activated. Each year the agreement is automatically renewed, if you wish to cancel or change the subscription you can do that right up until the date of renewal.

If Skywalkr wishes to cancel a subscription we will do this with minimum one-month notice. We do reserve the right to do this without warning if you are in violation of Skywalkr’s terms and conditions, in that case you will receive a written explanation of how you are in violation.

Liability

Skywalkr cannot be held responsible for any loss, directly or indirectly, including loss of revenue, lost profits, loss of data, loss of goodwill or brand value, technical breakdown, unauthorized access, or any other damages as a consequence of using Skywalkr hosting service. No matter if Skywalkr could be blamed the incident due to negligence or anything else.

Skywalkr cannot be held responsible for any loss, due to force majeure, including changed laws, authority measures, power failure, telecommunication / internet breakdowns, fire, explosions, water damage, break in and theft, terrorism or sabotage.

Content on Skywalkr’s servers

Skywalkr do not take any responsibility for the content (texts, videos. images or any file) you upload to the servers. But we do reserve the right to stop you from breaking the law, meaning that if you upload content that is against the law, or your hosting account and/or server is used for illegal activities such as spam, phishing, denial of service attacks or other. We will temporarily shut down your service until the issues is resolved, regardless of whether it is intentional or not.

Service Level Agreement (SLA)

Skywalkr does not limit the bandwidth (traffic) usage for any plans. However, in cases of extreme usage, intentional or not, we do reserve the right to temporarily shut down your service until the issues is solved.

Skywalkr’s main objective is to ensure that all systems are up and running 24 hours a day all year around. However, it is not possible for anyone to guarantee a 100% uptime, we do reserve the right to suspend all services for short periods of time (usually at night) due to maintenance, updates and other technical issues. Skywalkr is dependable of the 3. party vendors ‘Google Cloud Platform’, ‘DigitalOcean, LLC’ and ‘Amazon Web Services (AWS)’ and their scheduled maintenance, that will cause some downtime of servers.
We will always inform you in due time about planned maintenance and expected downtime.

Skywalkrs service via our support is always open to clients and we will help you in any way we can with anything about hosting, security and the speed of you website. The support is limited to advice, expect from changing server settings, domains, SSL and other small tasks. Other types of work like web-development, installation of special software or scripts on servers, or work related to hacked WordPress sites is not included in the support. This type of work will be charged 950 DKK / hour + VAT.

Payment

Payment is either by invoice or credit card (payment is 12 months up front). It is the responsibility of the client to make sure e-mails from Skywalkr is not blocked so that your invoice can be received, and that the invoice is paid before it is due, so that the subscription with Skywalkr can continue. When paying by credit card through Skywalkrs payment vendor (Stribe INC) it is your responsibility to keep your credit card updated, so the subscription automatically can be renewed.

Dispute Resolution

We do hope that we never have to enter into a dispute with any of our customers. If it gets to that point, we will figure out a solution before taking any legal measures.
